TERMS
1. Eligibility: The Promotion is open only to legal residents of the 50 United States and the District of Columbia (“D.C.”) who: (a) are 18 years of age or older, (b) are located in one of the 50 States or D.C. at the time of entry; and (c) have received an email or online invitation to participate in a Ruskin ASHRAE 2016 survey and are manufacturer representatives of Ruskin. Employees, contractors, directors and officers of Johnson Controls, Inc. (Ruskin). (the “Sponsor”), and their respective parents, subsidiaries and affiliated companies, retailers, sales representatives, dealers, distributors, licensees and the advertising, fulfillment, judging and promotion agencies involved in the development and administration of this Promotion, and each of their respective officers, directors, employees and agents (collectively, “Promotion Parties”), and their immediate family members (parent, child, sibling and spouse of each, regardless of where they reside) and those living in the same households of each (whether related or not) are not eligible. Void outside the 50 United States/D.C and where prohibited by law. If you are a deemed a minor in your state of residence (“Minor”), you must have the consent of your parent or legal guardian to participate in this Promotion. Proof of consent may be required at any time.
2. General Liability/Force Majeure Entrants agree that the Sponsor and each of their respective officers, directors, governors, partners, partnerships, principals, employees, volunteers, representatives, agents, affiliates, related entities, successors and assigns (the Promotion Entities collectively with such other entities and persons, the “Released Parties”) (A) shall not be responsible or liable for, and are hereby released and held harmless from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Promotion or from entrants’ acceptance, receipt, possession, use and/or misuse of any prize, and (B) have not made any warranty, representation or guarantee of any kind, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose, and disclaim any implied warranty. The Released Parties assume no responsibility for any damage to an entrant’s or any other person’s computer system or wireless phone for participating in Promotion, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, the Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen entries, email or mail or prize notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. The Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Promotion, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Promotion or to annoy, abuse, threaten or harass any other person, and the Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. No mechanically-reproduced, illegible, incomplete, forged, software-generated or other automated entries will be accepted. The Sponsor reserves the right to modify, extend, suspend, or terminate the Promotion if it determines, in its sole discretion, that the Promotion is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Promotion. In the event that Sponsor is prevented from awarding prizes or continuing with the Promotion as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state/province or local government law, order, or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within the Sponsor’s control (each a “Force Majeure” event or occurrence), then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, or terminate the Promotion. If the Promotion is terminated or suspended before the designated Promotion Closing Date, notice thereof will be emailed to all eligible participants and the Sponsor will (if possible) select winner(s) in a random drawing or drawings from all eligible, non-suspect entries legitimately received as of the date of the event giving rise to the termination. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor reserves the right to correct clerical or typographical errors in promotional materials or these Official Rules.
2. Promotion Period: The Promotion begins at 3:00 p.m Central Time ("CST") on March 2nd 2016 and ends at 11:59 p.m. UTC on March 23rd 2016 (the "Promotion Period").
3. How to Enter: Enter the Contest during the Contest Entry Period at https://www.surveymonkey.co.uk/r/LPGZDZ2 ("Promotion Site"). The survey must be filled out in its entirety to be a valid entry. Each person who registers with the Promotion Site earns one (1) chance to win one (1) Apple Watch. This Promotion is not affiliated with Apple Inc.
a. Survey Entry: During the Promotion Period be invited by Sponsor or opt to participate in a survey associated with this Promotion, follow the link to the survey website, and complete the survey online. Once at the survey, you should complete the questions provided. Entrants must complete all required information. After you have completed the survey, you will also receive one (1) entry into the Prize Drawing. The length of time required to complete a survey will vary from approximately three (3) minutes to thirty (30) minutes. LIMIT ONE (1) SURVEY ENTRY PER PERSON / E-MAIL ADDRESS / COMPLETED SURVEY ASSOCIATED WITH THIS PROMOTION.
b. Mail-in Entry: You may enter the Promotion by printing (in the following order) your valid full name, street address, city, state, zip code, and telephone number on a standard 8 1/2″ x 11″ sheet of paper and mail it to: 3900 Dr. Greaves Rd, Kansas City, Missouri 64030 (“Mail-in Entry”). Mail-in Entries must be postmarked within the Promotion Period and received within 7 days of the end of the Promotion Period. Each Mail-in Entry must be mailed separately. A representative of Sponsor will play an instant win game with the same odds and prizes on your behalf for every valid Mail-in Entry received. You will also receive one (1) entry into the Prize Drawing. Only potential winners will be notified by email or telephone. LIMIT ONE (1) MAIL-IN ENTRY PER PERSON.
4. The Prize: Ruskin will award one (1) Apple Watch to one (1) contest entrant. Approximate retail value (“ARV” of prize is $349.00 (USD). Ruskin will contact the contest winner. There will be no cash compensation. Ruskin will not replace any lost or stolen prize items. Prize must be accepted as awarded and may not be sold or transferred and is not convertible to cash. The Sponsor reserves the right to substitute a prize in whole or in part in the event that all or any component of the Prize is unavailable. All federal, state, local and other taxes are the sole responsibility of the applicable winner. Prize must be redeemed within 12 months of prize notification. Prize packages will have no value after this date.
Winner Selection: Winners will be selected in a random drawing from among all eligible entries received throughout the Promotion Entry Period. The random drawing for the Promotion will be conducted March 30th 2016. The random drawing will be conducted by Ruskin; all decisions are final. Odds of winning will depend on the number of eligible entries received. Winners will be notified by email within ten (10) days of the random drawing. Ruskin is not responsible, and may disqualify an entrant, if the entrant's email does not work or is changed. Any winner notification not responded to within 30 days or returned as undeliverable will result in Prize forfeiture and an alternate winner shall be selected. If a potential winner is ineligible to win the Prize because of material misrepresentation, does not comply with the acceptance requirements above or is otherwise in violation of these Official Rules, then such winner will be disqualified and an alternate winner may be selected from the remaining eligible entrants. No substitution or transfer of a prize is permitted except by Ruskin.
5. Release & Waiver: By participating in this Promotion, entrants agree to release, discharge and hold harmless Promotion Parties from and against any and all liability, loss, injuries or damages associated with participation in this Promotion or the acceptance, possession, use or misuse of any prize received in this Promotion. By participating in this Promotion, entrants waive all rights to claim punitive, indirect, incidental and consequential damages, attorneys’ fees or any damages other than actual out-of-pocket costs incurred to participate.
6. Publicity: Acceptance of a prize constitutes permission for the Sponsor and its agencies to use winners’ names and likenesses for purposes of advertising and publicity in all media worldwide without further compensation or notice, unless prohibited by law.
